1. The Demesne Land Of The Former Abbotsbury Abbey 1543

After the dissolution Sir Giles Strangways leased the site of the Abbey and its lands in Abbotsbury in 1541. Two years in 1543 he obtained the freehold of Abbotsbury, with East Elworth, Bexington and pasture for 250 sheep at South Brendon in Portesham from Henry VIII, [IvR, 1888, 23a]. The demesne lands were detailed as follows:

The map shows pasture enclosures to the N of the E field and to the West up to the Abbotsbury boundary. The larger closes are on the higher land at Castles and Weares. Smaller ones are to the west of Crookhills and between Bexington and Puncknole Way. Swans and ships are drawn in the margins.

To one side are two lists of tenants, one of tenaments, the other of cottagers. The former is headed as follows:

John Wallis, Grace’s late husband had the lease 7.2.1772 for 99 years, now determinable on the deaths of Sarah Crew, wife of Joseph Crew of Abbotsbury, yeoman, formerly called Sarah Wallis.

Leased to Grace -

"All that messuage or tenement called a whole place .... in Abbotsbury... with common of pasture within the fields & commonable places of Abbotsbury ... for 2 horses, 10 rother beasts & 120 sheep" with all appurtenances, formerly in the tenure of John Trevit, afterwards of Stephen Hansford, then of Gregory Handsford, since of John Oliver & late of the said John Wallis ... excepting trees, mines, quarries.

To Grace Wallis for 99 years, but to be completed & ended if the said Grace Crew aged 62 years, the said Sarah Wallis aged 36 years & Susan Wallis, daughter of Grace Wallis, aged 11 years, shall live, for 17s 9d rent, paying a Heriot or ffarleiff. Repair premises ... taking ... House Boot, Hedge Boot, Fire Boot, Gate Boot, Bar Boot, & Stile Boot of the paring, lops and shrouds of trees as have been formerly lopped without delivery of any timber trees ... to be used on the premises, with no waste, sale or destruction.

Give attendance at court baron or customary courts of manor of Abbotsbury and observe Bye laws ... paying fines etc., paying rent and herriot within 14 days of the due date, paying any fine for damage within a month, may sublet for a maximum of 5 years.

Abbotsbury Manor

The Presentment of the Homage together with the Overseers of the Common Fields of Abbotsbury at the Court Baron held of the Honourable Stephen Digby Fox Strangways Guardian of the Rt Honourable the Earl of Ilchester, Lord of the Manor held on Tuesday the first Day of October in the year of our Lord 1805.

First, We present by ancient Custom of this Manor, that the Lord or Lords of this Manor have been intitled unto and ought to have several sorts of Fish called Price Fish from the Seine Men, which by them are taken in the sea within the Bounds or Limits of this Manor, at such Prices as are accustomed to be paid for the same, according to the said Custom, every one herein offending to forfeit forty shillings for every offence.

Also, we order that Barley Field be Hayn’d from all Cattle the 25 Day of March and to be broke with Rother Beast the eighteenth Day of September, provided the Corn be all carried off, if not a time to be fixed by the Overseers of the Common, and the major part of the Tenants, when it shall be Brake, every one so Offending to forfiet (sic) 5 Shillings for every offence and the wheat fields and common meadow be broke with Rother Beast seven Days after on paying 2s, 6d for every offence.

Also, We Order that no Sheep shall be kept or fed in any part of the Cow Lease in time of washing of shearing on paying 2s 6d for every offence.

Also, We Order that no person shall keep any Horse or Beast in any part of the Common Field without a Pasture on paying twenty shillings for every offence or any Sheep without a Pasture on paying Sixpence each Sheep so tresspassing for every offence and no person shall let a Horse or Beast Pasture twice on paying twenty Shillings for every offence.

Also,Wwe order that no person shall keep any Horse in the Wheat or Barley Field after 12 of August except Clover or Meadow Lands on paying 2s 6d for every offence and no person shall tie their Horses in any Clover Lands after it has been mowed twice on paying five Shillings for every offence.

Also, We Order that no Person shall cut Turf but in Bottomless pool Long Moor or such swampy places as the Overseers of the Common shall think fit on paying 20 Shilllings for every offence.

Also, We order that the Hayward shall have Sixpence per Score for all Sheep that shall tresspass in the Common if less than twenty, sixpence for any number under to one single sheep, and one Shilling each time they break fold and two pence per Head for all Horses and Beasts that shall tresspass on the Common and six pence for each Calf that shall be at large among the Corn.

Also, We Order that no Mare with a Colt sucking her shall be tied or leazed in any partof the wheat or Barley Field on paying twenty Shillings for every offence and that no Horse or Beast be tied or kept in any part of the Common on any pretence of being sick or lame on paying five Shillings for every offence.

Also, We Order that no Bull shall be kept after Woodbury Tide but such Bull as were kept in the Field at May day on paying ten Shillings for every offence.

Also, We Order that no horse or horses shall be kept at large in Seawell on paying Five Shilings for every offence and one Shilling the Hayward fees any Person may tie Calves in the Wheat or Barley Field for which they have Pasture after the Fields are Broke till the twelfth Day of August and not after on paying 2s 6d for every offence.

Also, We Order that no person shall tie any horse or Beast in the Wheat, Barley or any other stubble after the Corn is cut unless cut for fodder and no person shall on any pretence, mow any Grass or Rushes in the Wheat or Barley Field, on paying Twenty Shillings for every offence and we order that Wears shall be fed with sheep for the Year ensuing and Plains to be laid to the Cow Leases instead thereof on paying 2s 6d for every offence.

Also, We Order that all Persons shall give Notice in writing to any one of the Overseers of the Common what number of Horses or Beasts they shall put in the Common at May Day or within Six Days after and where such horses and beasts are pastured on paying Five Shillings for every offence. We order that all Beasts entered at May Day with the Cowherd shall pay the Cowherd till May Day following if any Person shall refuse to pay the Cowherd such beasts shall be impounded till the Cowherds Wages be paid and forfiet 2s 6d for every offence above the Coweherd’s wages.

Also, We Order that if any Shepherd shall be found leazing his Sheep in the Cowleaze or where they ought not to be he shall forfiet five shillings over and above the Haywards Wages.

Also, We Order that if any Person shall turn their Beasts into Noles before the time the Cowherd comes to take them before the 5 of April and the 12th of May on paying 2s 6d for every offence and no Cow shall be kept in the Common after Sunset on paying Five Shillings for every offence.

Also, We Order that no Horse shall be tied in the Meadow after the 12th of May on paying 2s 6d for every offence and no person that lets his own horse Pasture shall put his horse on his or any Cow Pasture on paying Ten Shillings for every offence, and no person shall cut Grass on any part of the Walls or Common on paying Five Shillings for every offence and no Ewe with a Lamb shall be tied in any Meadow or Clover Lands unless the Lamb be tied also and not to be tied on the Walls or in the Common on Paying one Shilling for every offence.

Also, We Order that no Person shall let a Horse go upon a Cow Pasture or a Cow upon a Horse Pasture on any pretence whatever on paying Twenty Shillings for every offence and we order the Hayward to impound all Sheep as shall be found in the Streets and Closes if the hayward refuse pound such Sheep he shall forfiet 2s 6d for every offence and if any Person leave his Cows in the Common after others are driven off he shall forfiet Forty Shillings for every offence and no Ox nor Steer shall be kept in the Common under the penalty of Twenty Shillings for every offence and we further order that no person shall let any Horse or Cow Pasture from May Day to Woodbury Tide and then let that Pasture again at Woodbury Tide to another Person but shall let his Pasture from May Day to May Day following to one Person only every Person so offending shall forfiet twenty Shillings for every offence.

Also, We order that all Strangers not inhabitants of the Town or any that do not belong the Town that shall take any horse or Cow pasture and let them again shall forfiet Five Pounds for every offence and that all Persons that let Cow Pastures to Strangers shall pay the Cowherd themselves, not for the Cowherd to go out of the Town for his Wages any Person that shall refuse to Pay the Cowherd shall forfiet Ten Shillings for every offence and we order that all Persons that stock Sheep pastures shall pen them regularly for the time and not to keep in the Common Field by Day and put them in their own Grounds by Night under the penalty of Forty Shillings.

Also, We Order that all Fishermen and others that go up and down the Meadow to keep one path if any one shall be found so trespassing he shall forfiet 2s 6d for every offence.

Also, We Order that if any Boy shall be found leazing more than two Horses at a time without the Carter being with him shall forfiet 2s 6d for every offence and if the Carter shall be found leazing more than two Horses at a time without the Boy he shall forfiet the same and the Hayward shall have six pence for each Horse he finds so Trespassing.

Also, We Order that no Person shall mow any Furze but in Wears, any one found so trespassing as Mowing Furze the South side of the Hill shall forfiet Twenty Shillings for every offence.

Also, We Order that the Wheat Field and Meadow which shall be so called after People begin sowing shall be Hayn’d from all Horses and Beasts the first Day of November and from all Sheep the 12th Day of November under the penalty of 2s 6d for every offence.

12. Temporary Stocking Order

Commisioners finding it impossible that the fences can be sufficiently made round the commonable pasture lands, so as to enable the different Proprietors to stock their respective Allotments this season Do hereby order -

1. That the same shall be stocked in common as heretofore (except the allotment to John Jennings which has already been fenced and partly sown to Corn ) in such proportions as are laid down in a certain schedule issued by the Commissioners for that Purpose.

2. That no sheep are to be depastured in Knowle or Plains until after Woodbury tide, that such sheep are not to be without a shepherd nor the cows to be without a Coward.

3. All horses to be tied but not with a Rope of greater length then 9 fathoms.

4. That these orders are not to affect the meadow or stables, which are to be depastured by the persons to whom the same have been respectively allotted.

13. Abbotsbury Enclosure, Notice of Public Carriage Roads, 7 Feb. 1810.

........ we have set out the following public Carriage Roads through and over the Commonable Lands of the said parish, that is to say,

No 1. The public carriage road of breadth of Thirty Feet beginning at the West End of the Town of Abbotsbury and extending in its present track south by Crook Hollows to the Beach, then turning Westwards by the beach in its usual track to the South West corner of Seawell Common leading toward Burton, (Castle Road).

No 2. One other public Carriage Road of the same breadth branching out of the last Described Road at Cleverlands and extending in its present track Northwestward over the Common by the Signal House to its present entrance into Bexington Farms being the road to Bridport, (Bridport Road).

No 3. Another Public Carriage Road of the same breadth beginning at the East end of a certain Lane called Hands Lane and extending Northeastward over the Higher Field to Bishopsway gate leading toward Dorchester, (Dorchester Road).

And that we have caused such roads to be marked and staked out and have prepared and signed a Map of the same, which is left at the office of Mr. Jennings of Evershot and a copy at the House of Mr. Clarke for inspection of all persons interested.

And we do hereby give further Notice that we have appointed our next Meeting to be holden at the House of the said James Tullidge, on Wednesday the 9th day of June next, at the hour of 11 o’Clock in the forenoon, for the purpose of hearing any objection that mey be made to the setting out of such Road. The Sherborne and Yeovil Mercury, 23 June, 1806

We, John Vivian, Augustus Elliott, and John Damon the Younger all of the parish of Fleet in the County of Dorset, fishermen, do hereby acknowledge, that the Right of the Fishery & Swannery in the Fleet, in the said County do and for time beyond the memory of man hath belonged to, and is the property of, the Right Honourable the Earl of Ilchester. and that no other person or persons hath any right to take, kill or destroy any fish; swan or swans therein (except the said Earl or his undertenant); and we do also acknowledge, that we have indifferently and unjustly fished in the said Fleet, for which Robert Pittman, a tenant to the said Earl, hath justly caused a prosecution to be commenced against us, but at our request, and on promising never to be guilty of the like offence, hath humanely forgiven us, on asking pardon, paying costs of suit and making this public concession. A Mistake

We, John Vivian, Augustus Elliott, and John Damon the Younger all of the parish of Fleet in the County of Dorset, fishermen, do hereby acknowledge, that we being poor and ignorant men, scarcely able to read and write or understand, have very indifferently and unwarily suffered an advertisement to be inserted in the Sherborne paper of June 23, declaring that we believe the right of the fishery and Swannery in the Fleet, in the said County, to belong the Right Hon. the Earl of Ilchester. Now we do hereby acknowledge, that we have been greatly misled in making this assertion and that we meant and thought we were speaking of that part only of the Fleet, which lies within the limits of the parish of Abbotsbury. As for the other parts of the Fleet, we have always heard and do firmly believe, that they are, and for time beyond the memory of man, have belonged to, and are the property of the Lords of the Manors whose lands they adjoin; and we humbly beg pardon of the said Lords of Manors, for having permitted a representation to be signed with our names, so contrary to their interests, and to what we believe to be true.

The three men who were shooting coots in the Fleet have expressed great sorrow for having don so & have paid all expenses of information & have promised never to offend again. As there was very great difficulty in the case, as they only killed coots which may not come under the meaning of the Act of Parliament & as Mr. Sparkes who gave them leave to shoot there and seem’d to suppose he had a right to do so, has, as the Mr John Henning of Weymouth their att(orne)y informed me, given orders to his people not to shoot there again. I have thought it much more prudent not to press the matter but to undertake for you that you would be satisfied with their submission, and Besides the doubt as to the Coots, the question involved your right to the Whole Fleet, which claim I urged in the strongest terms to Mr Henning, altho the Information was not laid before me, but when I became an intercessor, and it seemed to be allowed on all hands (altho Mr Henning had not heard it before) that this was generally understood. So that on the whole I think it better to let the matter go off in this manner, at least. I asked for you as I should for myself.

The trough placed in the year 1812 in the Back Water at Abbotsbury for the use of the Revenue Officers for the prevention of smuggling should be removed as the same is stated to disturb your Lordships’ swans.

And it appearing that smuggling is carried on to a very considerable extent in the said Back water and that without ....(top of letter torn) in question the officers in the service of this Revenue will be much impeded in the execution of their duty and it having been also represented that there are at least a dozen Troughs kept by the smugglers in the said back water for the purpose of sinking and taking up their goods. I have it in command to state this matter to your lordship, and it appears that a considerable number of seizures have been made by the officers in consequence of their being permitted to .... trough on the said back water, to signify the request of this Board that your Lordship will be pleased to allow the said Trough to remain.

I have to acknowledge the receipt of your letter requesting to make use of a boat on the back water called the Fleet which lies between Abbotsbury and Weymouth. It is, I assure you, my wish to give every assistance in the detection of smugglers on that coast, at the same time I feel so much annoyance from having the boat where it has lately been kept, that it has determined me to desire it might be forbidden. I have for several years most especially prohibited any person except myself from keeping a boat on that part of the water, within or near the Parish of Abbotsbury in order to keep my swannery decoy which is mostly confined to that end of it, as quiet as possible, and which has also acted in a great degree to the prevention of smuggling at that place. Under these circumstances I trust the Board will immediately give directions that the boat may be moved from that end of the Fleet and I conceive will be found infinitely more advantageous for the object in view if kept on any other part of the water near Weymouth to which ..........(torn).

I have to inform your Ldshipp on Saturday last there was six boats came up the Fleet with twelve people in them, they consisted of five apear to be Captains of Vessels or Lieuts the other two Doctor Allen of Weymouth, and Capt Meech, the other five was, Henry Goodridge Joseph Spraklun, Thos Stone, James Powel, and Bushell, these five were people emploid to tow them, (all five belonging to Wyke Regis ), they came up as far as Langton where they went to the Inn and got some refreshment, About four O Clock in the Evening they came on as far as Corbett’s House and Shot four or five times, Corbett and Shier was both there but did not see them kill any thing. They said they did not mean to do any harm.

I think it would be Nessary to give thees Notices we know, if your Ldship aproves of it, three of the five that Tow’d them are men frequently shooting on the Fleet the other two are Boys. I cannot find out the other five Gentlemen’s Names.

I have also to Inform your Ldship of a cottage house fell in hand Thursday / last by the death of Jane Limm, its almost at the East end of Rodden Row.

Lord Ilchester’s complt to Capt Meech and understanding he was last week with a large party shooting wild fowl on the Fleet near Abbotsbury takes this method of requesting the circumstance may not again occur being particularly anxious to keep his decoy & Swannery as quiet and undisturbed as possible.

Receiving a letter from your Lordship this morning dated March 7th respecting a party of Gentm Shooters who I believe extended their passage a little beyond their own inclination trusting the men who were hired with the boats nearby for the sake of wild Fowle shooting but being stopped by a very insolent man who refused to show his authority and at the same time using very dangerous language they returned, but meeting with me near Langton and informing me with the occurrance, I immediately desired my men to proceed forward to see who this man could be that behaved so rascally and recognized him to be your Lordships underkeeper I addressed myself to him, and desired that he would particularly state the truth to your Lordship but fearing the man has not done us justice having heard of many petty transactions (of him as a keeper) I take the liberty of stating the real facts, and the Party Major Faulkner, Captain Deripple- Ms Cloud, Fry, Meech and myself we left Weymouth in Separate Boats to proceed as far as Fleet to endeavour to shoot some wild Fowle, and to dine at Langton, The Tide was so exceedingly low that we could not get along so much so that we were compelled to go ashore at Fleet and walk to Langton. after dinner we agreed to go and see your Lordship’s Swannery, and at the same time to try if we could meet with any wild Fowle, as to myself I can with propriety state that I never fired a Gun off the whole of the day, moreover that it was the first excursion of the kind, that I ever made in thee whole course of my life. and I do most solemnly declare that not one bird of any kind was killed the whole of the day and but one coot shot at.

Sir,

Will you have the goodness to inform his Ldship as Corbot Pittman was in his way back from getting the Swans home coming on through Langton Field he saw three Men in a Boat on the Water Opposite South Slaite. Suspecting they had Guns with them, he went to Langton and got Goding to asist who now lives at Langton, after waiting on Langton side some short time they heard them discharge there Guns four times, they came ashore on Langton Manor, just where they was waiting for them as there is no other way they could get in there Boat for Ice, they had thirteen Coots no other Birds whatever, two Guns they took which I have at my House, Corbet and Goding came to let me know what had happen’d. About 9 O’clock We all set of and took the Boat also, and drawed it on Ice as far as Pittman’s and Lockd it, the threemen ar Willm Whittle, John Parkins, and Joseph Parkins all of Langton, the two Parkins I was at the taking some years ago for Shooting close to the Decoy.

Customs House

Brown the Customs House officer of Abbotsbury appeared before us today at Dorchester to answer to an Information laid against him by your Tennant Bryant for using a gun for the purpose of killing Game. He was not convicted, ther being no proof that what he killed was game. the witness did not search his pocket and Brown said it was a rabbit. Brown had with him one of the Soldiers quartered at Abbotsbury but no information was laid against the soldier as he was not known and Brown carried and used the Gun. Having had Brown very frequently before me and knowing him to be of an extremely bad character, I said that I should recommend his being served with a notice not to trespass on any of the Grounds and if afterwards he was at any time seen out of the roads, proceeding against him. Brown answered that his (duties?) as a Customs House officer required his being in different places out of the roads at all times, and he could not be prevented from that, but he owned he had no right to take a gun with him. This claim of being authorized to go wherever he may think it necessary on his duty, tho’ certainly just what a customs house officer must have to protect the Revenue, makes it nevertheless, much more difficult to prevent him if he takes to Poaching. and may also lead to the doing of the same sort, such as going armed at night into woods. And shows the extreme care ought to be further in the appointment of persons of good character as Customs House officers. Mr Weston the collector of the customs at Weymouth has long known my opinion of Brown and he told me that the Board were aware of his character. I cannot help thinking therefore that it would be very desirable for you to state his conduct to the Board and request his immediate removal, as his character is so notoriously bad in every way that his continuing in his situation must bring great discredit on the office he holds, which is already too liable to be complained against, even in the exercise of the common and necessary duty.

Request to take the trouble of writing a letter to the Board of Customs stating the grounds on which you are anxious to obtain the removal of the officer. I am sure it would be received with every desire on the part of the Board to meet your wishes as far as the rules of the Service will admit; Or perhaps it would save your Lordship some trouble if you were to go to the Treasury at once to apply to their Lordships through the medium of their Secretary to that Board to have the grievance you have experienced from the vicinity of this officer ....... From what I recollect of what passed on this subject on a former occasion I am disposed to think the latter plan would be the best. A letter either to Mr Luckington or Arbuthnot would be sufficient unless Your Lordship should also be inclined to speak to either of them on the subject, whoud would very probably be the means of obtaining a more prompt and ready attention to the business.

Three Swans have been killed this morning in our Backwater and as there is little or no doubt but that they belong to your lordship I have, as one of the Borough magistrates, directed our constables to ascertain who are the offenders and to obtain sufficient evidence against the parties in case it should be your wish to institute procedings against them.

Case of Swans and of W Cockburn’s Opinion thereon. Box 333

The Manor of Abbotsbury in the County of Dorset with certain Royalties and extensive privileges appertaining thereto is the Property of the Right Honourable The Earl of Ilchester, who has inherited the same through a long line of Ancestors, the same having been granted to Sir Giles Strangways 35 Hen: 8 and in the 35th of Eliz. 100 Messuages, Wreck of the sea, Exemption from the Power of The Lord High Admiral of England in this Manor, The Water Soil, The Fishery called The East Fleet and the Flight of Wild Swans called The Game of Swans yearly breeding nestling & coming there, were held by Sir John Strangways of the Queen in Chief; And also the site of the Monastery, View of Frankpledge and Court Leet in Abbotsbury, The flight of Wild Swans & breedings in the Estuary or Water called the West Fleet in Abbotsbury.

In the 32nd Eliz. it was found that from the Village of Abbotsbury to the sea by the Island of Portland is an Estuary Meer or Fleet, in which the sea ebbs and flows and in it are 500 Swans; 400 white and 90 signets each of the Value of 2s 6d the greater part whereof are not marked & which were in the possession of Joan late wife of Sir John Young Knight, which Lady was a Strangways. A writ was ordered out of the Exchequer to the sheriff to seize All White Swans not marked, who returned that he had seized 400. Hilary Term 34th Elizabeth.

The Defendants Pleaded that the Abbots were seized ov(er) The Estuary, Banks, and Soil in Fee, and that there was time out of mind a Game or Flight of Wild Swans haunting there, which were not accustomed to be marked, And that the Abbot & his predecessors did breed up for the use of their Kitchen & Hospitality some of the lesser Cignets & used yearly to mark them by cutting off the pinion of The Wings to prevent their flying away & that the King granted it to Giles Strangways 35 Hen: 8 and prayed quod manus dicta domine Regina a..ocantur. Upon which The Queen’s Attorney General did demur in Law. See this case reported in Coke’s Rep. P 156 and also mentioned in Chitty’s Book on the Game Laws p. 883.

It appears by this Case that it was resolved that All White Swans not marked may be seized to the King’s use by his Prerogative, as the Swan is a Royal Fowl, & and all those the Property whereof is not known do belong to the King by his Prerogative. But it was further resolved that a Subject might have property in White Swans not marked, as some may have Swans not marked in his private waters, the Property of which belongs to him & not to the King, and if they escape he may take them again and there with agreeeth Bracton, Bracton Lib. 2 v.1 fo. 9, so autem animalia fera facta fuerint mansueta et ex consuetudine eunt et redeunt volant et revolant (ut sunt Cervi Cigni Pavones et Columba et huius modi eosque nostra intelligantur quamdiu habuerint animum revertendi. But if they have gained their natural liberty & are swimming in open and Common Rivers the King’s Officer may seize them for the King, for one White Swan without pursuit cannot be known from another and the same being in its nature a Royal Fowl doth belong to the King.

It appears also out of this Case these points were observed concerning Swans, Vizt. That every one who hath Swans within his Manor hath a Property in them. That one may proscribe to have a Game of Swans with his Manor as well as Warren or Park. That he who hath such a Game of Swans may prescribe that his Swans may swim within the Manor of another. That a Swan may be an Estray and so cannot be another Fowl.

And it further Resolved that the Defendants in this case may have alledged that within the said Creek there had been time out of mind a Game of Wild Swans not marked building & breeding, & presented that such Abbot and all his Predecessors & had used at all times to have & take to their use some of the Game of Wild Swans and their Cignets within the said Creek & it wod be good, for altho’ Swans are Royal Fowls yet in such a manner a Man may prescribe in them for that may have a lawful beginning by the King’s Grant. For in Ro. Parliamt. 30 Ed 3. Pt 2, No 20 The King granted to C.W. all Wild Swans unmarked between London & Oxford for 7 years. In eodem Roll an. 16 R 2.. P 1, No 39 The like Grant of Wild Swans unmarked in the County of Cambridge to B. Beresford Knt. by which it appears that the King may Grant Wild Swans unmarked & by consequence a man may prescribe in them within a certain place because it may have had a lawful beginning.

The Fleet is divided from the Sea in the South side by the Beach or Shingle called the Chesil Bank which forms its Southern Bank or Boundary. The Number of Swans kept on the Fleet has varied. At present there are upwards of 400. These Swans are accustomed to nest breed and frequent the Waters of the Fleet, & the Banks and Soil thereof and are under the Care of a regular Swanherd kept by Lord Ilchester who has always taken and disposed of the Swans at his Will and pleasure. Some are marked others are not. Many of them have been from time to time destroyed, when taking flight at any distance from the Fleet, & sometimes are sureptitiously killed on wing over the waters thereof, or whilst swimming thereon, or reposing on the Banks by Persons pretending to be seeking Wild Fowl.

About a Month since, at midnight, three Guns were fired by a Party of men from the Chesil Beach at some Swans on the Fleet, two of which were badly wounded. Two of the men directly after firing got into a Boat & rowed after the crippled Birds, but upon being observed did not take them up, which no doubt they wd otherwise have done. Whether these two swans were marked or not is unknown, the Birds never having afterwards been taken.

At the Old Bailey Sessions in June 1824 four men were indicted for Stealing Swans from the River Thames (two belonging to the Dyer’s Company and one of His Majesty) marked and pinioned found guilty, and transported. This case is in point as to Swans marked being the subject of Larceny, but in the present instance the question is how far Swans not marked frequenting certain localities, are protected, and in what way any Person wilfully injuring killing or stealing them are liable to be punished.

The Right of Lord Ilchester to the Fleet & the ground & soil thereof, can be proved by documentary Evidence & is undisputed, & his right to the Swans harbouring there also is undenied & some of them as before observed, consequently marked. His Lordship has also the Sole Right of Fishery in & over the whole waters of the Fleet & maintains an Oyster bed in a part of it near Wyke; He has also the exclusive right of taking Wild Fowl thereon, & has a Decoy connected with the Fleet for the purpose of taking them. It is true that Persons from the neighbourhood have occasionally during the Winter Seasons killed Wild Fowl, & at other times taken Fish on the Fleet with little Notice taken of them by Lord I. but this his Lordship intends to prevent in the future without his permission, in consequence of the frequent depradations committed. But any attempt to kill take or injure any of the Swans have been always resisted.

Under the circumstances before stated, You are requested to advise Whether as Lord I. is entitled to all Swans by Prescription (or Grant) upon the Waters of the Fleet haunting there eunt & reunt volant er revolant a Person wilfully injuring killing or stealing a Swan unmarked there, on wing, swimming or reposing on the Banks is not guilty of Felony as the Good and Chattels & his Lordship & may not be indicted for so doing accordingly? And whether, in order to obviate any difficulty in proof of identity ( the Swan being unmarked) in another Court it may not be laid the Property of the Queen, All Wild Swans being Royal Fowls & belonging to her Majesty by her Prerogative?

Supposing that such an Indictment cannot be sustained you will please to advise how far the 31 Sec. 8: Geo 4. c 29 applies to offences of this nature And whether an Offender may not be convicted and punished under that Sec. of the Statute?

You will also be pleased to advise his Lordship on the best Course to be pursued in order to prevent persons in future from trespassing on the Waters of the Fleet for taking Wild Fowl or Fish or any other pretence, And if the Boats in which Persons are there found may not be seized?

And generally to advise the course you would recommend to be followed to ensure the conviction & punishment of all Offenders in future.

I have looked into the authority on this subject; I am of Opinion that an Indictment for felony cod not be sustained agt. persons taking Swans not marked & pinioned from the Swannery in question. The Property of The Earl of Ilchester as acquired by Grant or Prescription appears to me to be limited to having the exclusive Right to take the Swans; any interference with which right wod be matter of Civil Action only; but I am of Opinion that the Earl has not such a Property in the Swans till taken (of which taking unless the Bird be killed marking & pinioning wod be the best) as wod be sufficient to support an Indictment. If however the Swans be marked & pinioned I incline to think that an Indictment may be sustained for taking them as long as they are within the waters in question, but not when out of them.

Tho’ I do not feel quite positive on this point I should certainly recommend an Indictmt should be preferred agt any one who shall take any Swan which has been pinioned & marked, as the effect of a Conviction might be effectually to deter others: and in order to render it easier to institute criminal Proceedings I shod recommend that for a time additional pains shod be taken to pinion & mark the Cygnets, so as to increase the chance, if any Swan shd be taken of its being one in which the Property can be laid in Lord Ilchester so as to support an Indictment.

I entertain no doubt that a civil Action cod be maintained for any invasion of The Earl’s right in His Swannery. I shod recommend that notices shd be affixed in conspicuous places in the immediate vicinity of the Swanery declaring the Swanery to be private property and the right to take the Swans exclusively vested in his Lordship and Warning all Persons against trespassing or taking the Swans under pain of being proceeded agt according to Law.

I am of Opinion that the provisons of the 7 & 8 Geo IV c 29 & 31 do not apply to the present case.

Charged with malicious unjury to personal property.

Reg. v. Chickerell men, Wm Marshallsay, Wm Rendall, Rd Rendall. Felony, stealing a swan. Report 3 Jan 1860. Symonds of Wyke, near Fleet House, saw 3 men in a boat, a swan rose and the men fired, The swan fell & the men rowed up to it and took it into their boat. When they landed they took and hid it ..(under).. Rendall’s slop and hid it away. The police men went and took it up and took Marshalsay & Wm Rendall. Sentenced to imprisonment of 2 months with hard labour.

- Mon. 16 Jan. Corbet Pittman, and Robert Pittman, seeing 11 Boats & men spearing in the Fleet opposite South Sleigh Pound - wouldn’t leave.

- Tue 17 Jan. Writer saw 35 Boats Eelspearing on the Fleet opposite Bridgell c.2.00 in the afternoon. All went away as he approached.

- "Thursday following 19th inst I went with 7 men on the Fleet to tow up some timber that was washed ashore to the Boat House Reeds End. While we were there more than 30 Boats & men came up between the Berry and Bridgle eel spearing. They took no notice of us. I went with Corbet in the Boat to them & ordered them off but they would not go. I told the men the Fleet was Lord Ilchester’s Private Property & if they did not leave they must expect what would follow. Corbet Pitman, Gregory Hill and myself can swear to 5 of the men we saw with the other men.

In consequence of this letter of Swaffield’s Mr Baskett caused the 5 men to be served with a written notice similar in form to the notice set out in pages 2 & 3 of the case of 2nd April 1860. It cannot be ascertained that either Bartlett or Vivian has been up to the Abbotsbury waters since.

...........at Chickerell ........ the people there are almost all fisherman & hold together ........ The statement of the proposed defendant Vivian as given in the course of conversation & put subsequently into writing was to the following effect.

"am about 65 years of age and sailed for many years out of the Port of Weymouth. Was engaged in smuggling and was sent to prison for it. am part owner of Boats and seines. Was fishing up at Abbotsbury when Corbet Pitman saw about 30 boats just before the notices were served . Remembers as long ago as 50 years going pecking for eels up near Abbotsbury before the Swan was killed but not often as he was at sea & there were not many eels there then. When the swan was killed Lord Ilchester threatened to turn the people out of their Houses if they went again & after this the Langton, Fleet and Chickerell men did not go so far up. did not ago above Clay head or Langton Hive. I went up to Abbotsbury to fish 6 or 7 years ago. did not go again till lately. After I was seen by Corbet Pitmamn was served with notice not to fish & returned it stating that the steward should not stop me if he came himself. have caught eels lately there weighing as much as 6 or 7 lbs. Have not gone up since I was served with the notice but intend to go again. Several of the fishermen have for several years past agreed to put something aside every year to pay for defending any proceedings against any one of them & Mr Sparks & the Rev. Mr. Godden, Lords of the Manors of Langton and Fleet have agreed to assist saying that Lord Ilchester has no more right in the Fleet than they had. do not think that any money has yet been put aside. Lords of Manors having rights to the beach wreck and exclusive fishing are bound to bear the expence of burying dead bodies cast on shore, which no Lord has done for many years. Bartlett induced the men to go up further than they would otherwise have gone & took up Beer and treated them. In fact he was the "gang leader". Some of the eels were sent to the malenoir fishmonger, 110 Lower Thomas St.

John Cooper of Chickerell sold fish caught in Fleet worth £4 to Bartlett during last winter and Bartlett sold to Billingsgate. Thos Rose of Chickerell and Richard Mowlem of Langton the same Bartlett also selling to fishermen at Bath."

Hunden, Edward, Formerly living at Fleet where he resided a great many Years carrying on the business of shoemaking. Now living at Chickerell keeping a beer house. This man is a Cripple but owns a share of Boats and Seines. He is aboout 60 years of age. He says he remenbers people fishing up and down the Fleet for 50 years but that they did not go above Claylands and Langton Hive since the Swan was killed 40 years ago.

Mowlam, John, of Langton, Innkeeper, Yeoman and Owner of Fishing Boats and Seines. He is over 60 years of Age and has Sons who repeatedly peck in the Fleet. One named Richard earned as much as 10s in one day during this last winter and two younger sons Fished as lately as Thursday the 15th of May and caught sufficient for 6 or 7 persons. Both these two are under 21 years of Age and living with the Father. Mowlam says that until lately the boats have not gone ebyond Langton because they were stopped when the swan was killed.

Vivian, Henry, of Langton. This man appears to be a respectable man and married a cousin of Mr Kellaway, a farmer of Langton. (Continues much as last record).

Hardy, Henry of Langton. This is an old man over 68 years of Age working for the ..... Squire during the Winter Months and goes to the beach in the Summer. Says he used to go up to Abbotsbury about 30 or 40 years ago and can remember his father before him going up.

Meech, Christopher, of Langton. This is an Old man upward of 90 Years of Age, is very feeble and keeps to his house and will be called to prove that Pecking has been carried on in the Fleet ever since he can remember anything but he himself has not been seen.

Pitcher, ..... of Langton. This is another old man and lived as a shepherd to the Mr Kellaways for 40 years. He will prove that he has seen pecking ever since he first went to live there, but as he was at work at Langton this remark must apply to that portion of the Fleet.

These people it is believed will speak more particularly to the pecking up as far as Cleve or Kave they call it and just above Langton Hive but Vivian and Mowlam states they used to go close up to Abbotsbury and Peck there with the Abbotsbury men until one of the Abbotsbury men killed a swan and then Ld Ilchester threatened to turn them out of their Houses if they went again and after this the Langton, Fleet and Chickerell people did not go so far up, and have been induced now to go so far by Christopher Bartlett who took Beer up with them and treated them.

The men generally say they have always gone cooting (shooting coots) up there in their troughs and they argue that if they have a right to shoot they must to fish also. They say that nothing used to be said to their cooting, but sometime ago the keepers came to try to prevent them and since then they have taken out licences for shooting. They appear to think that proceedings will be taken and are very cautious of saying anything that may commit them - much of the information was given by Pond - who however does nto wish his name to be made use of. Say they wd not care a fig if it were only a summons to Dorchester, but they suppose Lord Ilchester’s first step will cost them £100 to defend. The Abbotsbury people have agreed to help but on the sly.

- The persons who signed this letter of which the within is a copy called this morning to ask for leniency on behalf of the defendants they stated to the effect in the letter. Mr Baskett suggested that they had better write a letter to his Lordship and dictated aloud the letter before them & after it was written he asked them whether that was what they intended to say to which they replied in the affirmative. He told them that he would make any alteration or addition they thought proper & there reply was that they did not wish to make any so they thereupon signed the letter. Mr. Baskett told them that he would send the letter to his Lordship tonight and would advise his Lordship that he might consider his end attained of showing the fishermen that he had the power to punish them & that his Lordship might now agree to show mercy & to give them their liberty on payment of the small amount of damages found by the Jury.

Boats from all the parishes from Weymouth to Burton come & fish & land their hauls upon our beach, which might I think be prevented.

Our people have behaved well in regard to Sunday fishing but the other parishes do not set a good example. 17000 were taken by a Weymouth boat last Sunday just beyond the boat house, and it is suggested that an application to Col. Cox might produce an order to the police to take the names of the boats and men with a view to fining them according to the law.

Dear Sir, A Young gentleman has been detected by one of his Majesties constables in shooting a swan on Lodmoor & has directed that he shall be taken in to Dorchester tomorrow so that the case may be heard at Petty Sessions. I write this as you may probably want to prosecute on the part of the Earl of Ilchester. Wed. April 21, 1865. ( Signature illegible).

The young gentleman that shot the swan this morning will have his examination before the County Magistrates at 11 am to Morrow Saturday. Joseph Pearce, Robert Lovell, Samuel Randall, John Randall, Hubert Brewer. The last name is not to be found as he has left the neighbourhood.

George Taylor the Swankeeper living at Chickerell states that they fired seven times and saw one of them take the swan out of the water, on their coming to the shore he proceeded to the boat and took up the swan which was lying in the bottom. Brewer who was in that boat said is that yours when Taylor said I think I have the most right to it and Brewer then said he picked it up, in the same boat was also Lovell & John Randall. In the other boat was Samuell Randall & Joseph Pearce. Taylor states he saw shot fired from both boats. I remain Your Obed. Servant, Mark Hopson.

1874, Oct 9. Reg. v . Brewsley & ....... Swan killing. Pleaded guilty to malicious injury and fined £2.10.0. Though unmarked, it was a young bird bred from Lord Ilchester’s swans which its keeper could recognise., [Box 333].

I am very sorry to hear that the Coast Guard men have been disturbing your decoys & have given orders that they are never to sail or row up to Reed’s End or land at the Swannery during Autumn and Winter months. A new order has come out lately about signalling passing messages round the Division & where your keepers house stands is on the sky line and the only place where they can make the semaphore signals to be seen and I will take good care they do not go beyond that.. The Chief Boatman in charge at Langton came in to see me yesterday in a great way and said that he knew nothing of any order about it, neither did I otherwise it never would have happen’d.
